A worker at a recycling plant sustained serious injury recently when both of his hands got caught in the feeder of a conveyor belt that led into a recycling device. Though it is not yet known whether or not any failures of safety devices on the machinery may have led to the accident, any time such an incident occurs, an injury lawyer who serves the New York area should be consulted as soon as possible to ensure that the rights of the victim are protected and that any benefits that are due can be pursued as briskly as possible.
West New York EMS personnel were called to the Eagle Recycling facility when the incident occurred. According to reports, the man’s hands became stuck when he tried to remove a piece of cardboard that had become jammed in the feeder. It was not clear why the machine did not immediately shut down when either the cardboard became jammed or when the man’s hands got stuck, but the machine continued running, and six of the worker’s fingers were severed.
Emergency workers rushed him to a nearby hospital for treatment where he underwent several hours of surgery. As when any workplace injury of this nature occurs, OSHA is conducting an investigation of the incident. OSHA did note that in the four inspections that have been conducted at the facility in the last three years, there have been 28 safety violations ranging from lack of personal protective equipment to fire protection and electrical systems issues.
Obviously, a range of variables can be involved in such an accident, and it can be difficult to determine exactly where the responsibility for the accident rests or if any negligence was involved. That is why having an experienced and knowledgeable injury lawyer to investigate and analyze the accident and subsequent injury can be so important. If, for example, the accident occurred because a safety mechanism failed, not only can those responsible for inspections and maintenance be held liable, but quite possibly, the manufacturer of the device may also have been at fault. If you are an injury victim, the best way to know which parties may need to be brought to account for your accident is with the help of an expert injury lawyer in New York.
