Provisional Waiver Expansion Paves the way to More Immigrants

The Department of Homeland Security (DHS) published new regulations expanding the provisional waiver, a procedure that allows certain undocumented immigrants who have U.S. citizen spouses or parents to effectively obtain pre-approval for reentry before they apply for immigrant visas within their country of origin. Within the new regulations, DHS will accept applications for the provisional waiver from those who have Lawful Permanent Resident (LPR or green card holder) spouses or parents.

Additionally, the brand new regulations effectively create a new conditional I-212 waiver allowing whoever has previously been ordered taken out of the U.S. eighteen, you are the provisional waiver should they have a citizen or permanent resident spouse or parent. Previously, whoever has been ordered removed by an immigration judge but who never departed the U.S. would need to request the Immigration Judge reopen the situation before they could sign up for the provisional waiver-a request that, in reality, is often procedurally impossible. Now, together with the conditional I-212 process, additional undocumented immigrants with U.S. citizen or legal resident spouses or parents will have the chance to legalize their status under U.S. immigration regulations.
